The Basic Steps for an Uncontested Divorce
An uncontested divorce occurs when you and your spouse agree to end your marriage legally. You agree on marital issues such as spousal support, a division of property and debts, and child custody. If this is the category your divorce falls in, the first step will be to complete the appropriate Washington State Court forms to start and complete the process.
Once you and your spouse agree, complete and sign the appropriate forms, the next step in the process is to file the Petition for Divorce with the appropriate court. The Petition is typically going to be filed where you or your spouse live, not where you were married.
Before you start this process, make sure you meet the state’s eligibility requirement such as:
• You or your spouse are legal residents of Washington state and
• The marriage is irretrievably broken
To start the 90 day waiting period, your spouse must sign the Petition to acknowledge that they received and agreed with the document.
During this time, you and your spouse should be working on resolving outstanding issues. Once those agreements are finalized, the last step of an uncontested divorce is to sign the final orders and present them to the Court for entry.
If during the process you or your spouse have objections or are unable to reach an agreement on everything, you may have to proceed with a contested divorce. A contested divorce may require court hearings or other attempts to reach resolutions.
